Acceptable use
Acceptable Use Policy
This Acceptable Use Policy ("AUP") explains what you may and may not do with ServerSpark services. It is part of our terms of service (article 9). If this AUP and the terms differ, the stricter rule applies.
1. Scope: which services and who
- This AUP applies to all ServerSpark services: game servers, Discord bot hosting, VPSes, web hosting and any service we add later, including our customer portal, SparkPanel and game panel.
- It applies to you as our customer and to everyone who uses your service: players on your game server, team members or co-admins you give access, users of your bot or website, and your own customers if you resell or share your service.
2. Permitted use
You may use our services for lawful purposes, within the resources of your plan, for example:
- running game servers for yourself, your friends or your community, including mods and plugins you are allowed to use;
- running Discord bots and other applications that follow the rules of the platforms they connect to;
- hosting websites, databases and development or test environments (VPS and web hosting).
3. Prohibited use
You may not use our services, or let others use them, for any of the following.
Illegal and harmful content
- Content showing sexual abuse of children. We have zero tolerance: we remove it, end the service and report it to the police.
- Content that promotes terrorism, incites violence or hatred, or threatens or harasses people.
- Infringing copyrights or trademarks: pirated or cracked software, leaked or stolen game resources and scripts, and unlicensed media.
- Fraud and deception: phishing, scams, fake shops, carding, selling stolen accounts or personal data, and money laundering.
- Adult (pornographic) content and real-money gambling or casino services.
Security and network abuse
- Malware, ransomware, botnets and command-and-control servers.
- Attacks on other systems: DDoS attacks (including "booter" or "stresser" services), port scans, brute-force attempts, and exploiting vulnerabilities without permission.
- Open proxies, open mail relays, Tor exit nodes, and public VPN or proxy services offered to others.
- Unauthorised access to accounts, systems or data, including our own systems and those of other customers.
Spam and platform abuse
- Sending spam or unsolicited bulk messages by email, Discord or any other channel.
- Discord bots that raid, nuke or spam servers, mass-DM users, act as self-bots, or otherwise break the Discord Developer Policy.
Resource abuse
- Cryptocurrency mining or similar proof-of-work or proof-of-space workloads.
- Using a game or bot plan for something else, for example as file storage, a download mirror or a video streaming relay.
- Sustained use that seriously slows down the node, the network or other customers.
Game and software rules
You must follow the licences and rules of the games and software you run, such as the Minecraft EULA, the Cfx.re (FiveM) Platform License Agreement and the rules of Steam games. Breaking those rules can also break this AUP, for example when you run leaked resources or sell features a game licence doesn't allow.
4. Laws, regulations and sanctions
- You must comply with Dutch and European Union law and with the laws that apply to you where you live or do business.
- You may not use our services if you, or anyone you act for, appear on a sanctions list of the European Union or the United Nations, or are located in a country or region under comprehensive EU sanctions. You may not use our services to do business with such persons or regions, or for activities restricted by export control rules.
- We may refuse an order, block access or end a service when this is needed to comply with the law or sanctions.
5. Your responsibility for others (sub-users and third parties)
- You are responsible for everything that happens on or through your service, including what players, co-admins, bot users and your own customers do.
- Make sure the people you give access to know and follow this AUP. If you resell or share your service, your own terms must include rules that are at least as strict.
- Keep your passwords, API keys and bot tokens secret. If your service is used for abuse because your credentials leaked, the abuse is still your responsibility, but we'll help you secure it.
6. Monitoring and enforcement
- Monitoring. We don't read your files or watch your content. We do automatically monitor resource use, network traffic patterns and security signals to protect our network and our customers, and we act on abuse reports.
- Measures. When we find or receive a well-founded report of a breach, we may, depending on how serious it is: send you a warning, limit resources or network access, remove or block specific content, temporarily suspend the service, or end the service.
- Without notice in serious cases. For serious breaches (such as child abuse content, malware, attacks or fraud) or when there is an immediate risk, we may suspend the service immediately. We tell you why as soon as possible.
- No refund for abuse. If we end a service because of a serious or repeated breach, you don't get a refund (terms, article 9). This does not limit rights the law gives you.
- Authorities. We report criminal offences where required and cooperate with authorities when the law requires it. We may preserve data that is needed as evidence.
- Objection. Disagree with a measure? Reply to our email with your explanation. We review it and reply within 14 days.
7. Reporting abuse
Report abuse of a ServerSpark service to abuse@serverspark.nl. Please include the IP address or server address, the date and time (with time zone), what happened, and any evidence such as logs or screenshots. We aim to respond to abuse reports within 2 working days, and faster for urgent cases.
8. Changes
We may update this AUP, for example when laws or risks change. The date at the top shows the current version. We email customers about important changes in advance, as described in article 14 of the terms.
